The basic facts of the case:

On January 6, 2023, Richneck Elementary School first-grade teacher Abigail “Abby” Zwerner was shot by her six-year-old student in front of her class. The bullet pierced Zwerner’s left hand and lodged into her upper left chest, two centimeters from her aorta, almost killing her. Zwerner alleged assistant principal Ebony Parker received multiple warnings earlier in the day that the six-year-old boy possessed a gun and that Parker failed to take the necessary actions to prevent the shooting, including directing a search of the boy and calling law enforcement.
Before the commencement of trial, defendants filed pleas in bar asserting the Court lacked jurisdiction to hear the matter pursuant to the Virginia Workers Compensation Act and that each defendant was immune from suit in accordance with the Commonwealth’s sovereign immunity. The Court denied defendants’ plea in bar pursuant to the workers compensation act, but granted defendants’ plea of sovereign immunity, in part. The Court found assistant principal may be held liable for gross negligence, but not for simple negligence.
The trial proceeded on a single count of gross negligence against Defendant Parker arising out of her assumed duty of care towards Plaintiff and others similarly situated in the school.
The defense argued that Parker in her role as assistant principal did not owe a duty of care to Zwerner and that, even if such a duty existed, Parker’s conduct was sufficient under Virginia law to satisfy any legal obligation. The defense also argued that Zwerner was contributorily negligent by not taking steps to search the boy herself or call 9-1-1.
The defense did not dispute that the damages resulted from the shooting. The defense argued that the injuries do not inhibit Plaintiff from returning to gainful and meaningful employment, specifically Plaintiff’s pursuit of a career in cosmetology in the aftermath of her time as a teacher.

I often speak with my clients who are in a moment of crisis to guide them to the person or resource who is best-suited to be their support system in that situation.

Leading up to legalization of marijuana in Virginia, Virginia NORML hosted a panel discussion in Virginia Beach to educate and have a conversation with the community about new policies taking effect July 1, 2021. Panelists provided in-depth insights on what can be expected so Virginians can avoid misinterpretation of the laws. Virginia is officially the first Southern state to legalize marijuana.

Kelly Cournoyer, Esq ., of Toscano Law Group took part in the panel alongside Jenn Michelle Pedini, executive director of the Virginia chapter of NORML, and Stephanie Morales, Commonwealth’s Attorney for Portsmouth, Va. NORML stands for the National Organization for the Reform of Marijuana Laws, an organization that acts as the public voice in advocating for cannabis legalization within public policy.

“I want to make sure the public does not find themselves getting into trouble based on some of the indirect discrepancies in the new laws,” said Cournoyer.

As a former New York prosecutor, Cournoyer had wide discretion to decline to prosecute the majority of marijuana cases presented to her. Today, as an attorney in Virginia, she now practices criminal defense, including marijuana and cannabis law at Toscano Law Group and serves on the NORML Legal Committee, which aims to defend individuals with marijuana charges.

Adults who are 21 years of age and up may have up to one ounce of marijuana on their person in a public place

The trial against our client Bryan Cage is underway with our lawyers and the Commonwealth working to select a jury.

This case has drawn a lot of media interest from around Hampton Roads, including The Virginian-Pilot which reports : "Cage, 50, is charged with attempted capital murder of a police officer. He also faces 100 charges of possessing child pornography and 32 charges of illegally firing a gun. The gun charges represent each time he is alleged to have fired at police that day in June 2017."

As experienced criminal defense attorneys, we know that, often, the prosecution’s case is far less concrete than is presented to the public in initial hearings. In this particular case, the public is about to learn a whole lot more. After four years, Bryan will finally have his day in court and we plan a vigorous defense against the state’s accusations.

All charges against client Charles “Chip” Lewis were dropped yesterday in Northampton General District Court related to a shooting in Eastville on January 22, 2021.
