Trial Underway of Client Accused of Attempted Capital Murder in Virginia Beach

"Cage’s defense attorney Diane Toscano said in her opening statement that Cage did not shoot Sweeney, and instead he was shot by fellow officers who were “shooting wildly and using reckless and aggressive police tactics.”

This morning's proceedings included opening statements by the prosecution and defense as well as testimony and cross examination of two witnesses. Defense attorney Diane Toscano's opening statement read, in part: 


“This case is about aggressive police tactics that unnecessarily put people in harm’s way and could have led to the killing of my client, Bryan Cage. Thankfully, it did not. 


You will hear from witnesses how this reckless disregard for human life led to a series of bungled events that law enforcement put into motion on that day.”

The trial against our client Bryan Cage is underway with our lawyers and the Commonwealth working to select a jury. 


This case has drawn a lot of media interest from around Hampton Roads, including The Virginian-Pilot which reports: "Cage, 50, is charged with attempted capital murder of a police officer. He also faces 100 charges of possessing child pornography and 32 charges of illegally firing a gun. The gun charges represent each time he is alleged to have fired at police that day in June 2017."


As experienced criminal defense attorneys, we know that, often, the prosecution’s case is far less concrete than is presented to the public in initial hearings. In this particular case, the public is about to learn a whole lot more. After four years, Bryan will finally have his day in court and we plan a vigorous defense against the state’s accusations.
