Toscano Law Settles Insurance Claim for $400,000 in Federal Court Servicemembers Group Life Insurance SGLI Interpleader

After months of work, Toscano Law Group settled an insurance claim in favor of its client, K.L., in the amount of $400,000. A judge in the federal Eastern District of Virginia accepted the Order to disburse funds immediately on behalf of our client.

The unique case involved a dispute between the law firm’s client – who the court upheld rightfully was the beneficiary of an insurance claim payable on death – and a family member of the deceased who was contesting the validity of the beneficiary. This case came as an Interpleader filing in Federal Court, which is a civil procedure device often used to resolve disputes arising under insurance contracts. (Video: What is interpleader?)

The deceased had listed our client as the beneficiary in their Servicemembers’ Group Life Insurance (SGLI) plan. After a series of hard negotiations with the other side, Toscano Law Group successfully had an Order entered to release the Interpleader funds in the amount of $400,000 on behalf of Toscano Law Group’s client.

Said leading trial attorney Diane Toscano, “When we did the research and looked at the case law on SGLI, we knew we could present a winning argument in federal court. We were prepared to go to trial, but we’re really pleased we were able to settle this SGLI case in favor of our client.”

She continued, “This is a great example of why clients should consider hiring a law firm like ours whose lawyers regularly litigate cases in state and federal courts. You never know when a seemingly small dispute will escalate to a full-blown trial.”
